This policy explains how 305 Ventures Corp, doing business as Point Break Funding ("we," "us"), collects and uses information through the Line of Capital portal at portal.pointbreakfunding.com (the "Portal"). The Portal is a private, invitation-only tool for merchants we fund and for our internal staff. It is not open to the public.
Information We Collect
- Account information — name, business name, email address, phone number, and the credentials used to access the Portal.
- Business and transaction information— your business’ funding activity, including advances, amounts available, payments received, fees, payoff figures, and related records.
- Technical and usage information — IP address, browser and device type, and the date and time of each action you take in the Portal, including requests you submit.
- Communications — messages you send us through or about the Portal.
We do not collect Social Security numbers, bank login credentials, or payment card data through the Portal.
How We Use Information
- To provide the Portal — showing your available amount, activity, and balances, and processing the requests you submit.
- To administer and service your account with us and to keep our records reconciled with our system of record.
- To verify and document the requests you submit. We record the account used, the date and time, the IP address, and the device for each request. We use this to confirm authorization, prevent fraud, and resolve disputes about whether a request was made.
- To communicate with you about your account, and to notify your referring broker when a funding agreement is signed.
- To meet legal, regulatory, audit, and recordkeeping obligations, and to establish or defend legal claims.
How We Share Information
We do not sell your information, and we do not share it for advertising. We share it only as follows:
- Service providers that operate the Portal on our behalf — our hosting, database, and email delivery vendors, and the platforms we use for account servicing and electronic signature. They may use the information only to provide services to us.
- Your referring broker (ISO), if one referred you, in connection with agreements you sign.
- Professional advisors such as our accountants, auditors, and attorneys.
- Legal and safety — when required by law, subpoena, or regulator, or to establish, exercise, or defend legal claims.
- Business transfers — in connection with a merger, financing, or sale of assets.
Cookies
The Portal uses only cookies that are strictly necessary to keep you signed in and to keep your session secure. We do not use advertising cookies, marketing pixels, or third-party analytics trackers in the Portal. Because these cookies are essential to the service, they cannot be disabled without preventing sign-in.
Data Retention
We keep account and transaction records for as long as your relationship with us is active and afterward for the period required by applicable recordkeeping, tax, and limitations rules — generally at least seven years. Records documenting requests you submitted are retained on the same basis and are not deleted on request where we must keep them for legal or dispute-resolution purposes.
Security
We use encryption in transit, access controls that limit each merchant to their own records, individually assigned staff accounts, two-factor authentication on internal access, and routine backups. No system is completely secure, and you are responsible for keeping your credentials confidential and for activity that occurs under your login.
Your Choices and Rights
You may request access to, correction of, or a copy of the information we hold about you, and depending on your state of residence you may have additional rights, including the right to request deletion or to appeal a decision. We do not sell personal information or share it for cross-context behavioral advertising, and we do not discriminate against anyone for exercising these rights. Some information must be retained to meet our legal and contractual obligations. To make a request, contact us using the details below; we may need to verify your identity first.
Children
The Portal is a business tool and is not directed to anyone under 18. We do not knowingly collect information from children.
Changes
We may update this policy. If we make a material change, we will update the date above and, where appropriate, notify you through the Portal or by email.
